Please read these terms carefully before using the Zungo platform.
Welcome to Zungo. These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the Zungo website, mobile applications, and all associated services provided by Zungo ("Zungo", "we", "us", or "our").
By accessing or using the Zungo platform, establishing an account, or clicking to accept or agree to these Terms when this option is made available to you, you agree to be bound by this Agreement. If you do not agree to these Terms, you must not access or use our services.
1. Definitions
- "Platform" refers to the Zungo mobile application, website, and digital infrastructure.
- "User" refers to anyone who accesses or uses the Platform, including Customers and Vendors.
- "Customer" refers to individuals or entities looking to book services for events, parties, or weddings.
- "Vendor" refers to independent service providers (e.g., DJs, decorators, caterers, venues, makeup artists) offering their services on the Platform.
- "Booking" refers to a confirmed agreement between a Customer and a Vendor facilitated through the Platform.
2. Platform Overview & Scope of Service
Zungo acts as a premier digital aggregator and intermediary bridging the gap between individuals looking to host events and verified independent entertainment, hospitality, and event service providers. We provide a digital marketplace to discover, communicate, negotiate, and facilitate payments.
Crucial Disclaimer: Zungo is not an event management company, catering service, or entertainment agency. We do not directly employ the Vendors on our platform. The contract for the provision of services is strictly and directly between the Customer and the Vendor. Zungo accepts no liability for the exact execution, quality, or safety of the services provided by the Vendor, though we strictly enforce community standards and vendor verification.
3. User Accounts & Registration
To access most features of the Platform, you must register for an account. By registering, you agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account or any other breach of security.
We reserve the right to suspend or terminate your account at our sole discretion if we suspect that any information provided is inaccurate, fraudulent, or violates these Terms.
4. Rules and Obligations for Customers
As a Customer using Zungo, you agree to:
- Use the Platform solely for lawful purposes and not for any illegal or unauthorized activities.
- Communicate with Vendors respectfully and clearly state your requirements.
- Make all required payments for Bookings strictly through the Zungo Platform. Attempting to bypass the Platform for payments to avoid fees is a direct violation of these Terms and will result in immediate account termination.
- Ensure the event location is safe, accessible, and provides the necessary basic amenities for the Vendor to perform their services.
5. Rules and Obligations for Vendors
As a Vendor using Zungo, you agree to:
- Provide truthful representations of your skills, equipment, past work, and availability in your portfolio.
- Honor all Bookings accepted through the Platform. Unjustified cancellations harm the ecosystem and will negatively impact your Zungo trust rating, potentially leading to platform removal.
- Maintain all required local, state, and national licenses, permits, and insurances required to operate your business.
- Execute the agreed-upon services professionally, punctually, and to the best of your ability.
- Not solicit Zungo Customers for direct off-platform future bookings to circumvent Zungo fees.
6. Payments, Fees, and Escrow
6.1 Booking Process: When a Customer requests a Booking, the Vendor must accept or decline within the specified timeframe. Upon acceptance, the Customer will be charged the total booking amount (or an agreed-upon deposit).
6.2 Escrow System: Zungo utilizes a secure escrow system. Funds paid by the Customer are held securely by Zungo until the event concludes successfully. Payouts are initiated to the Vendor post-event according to our payment schedule, subject to our fee deduction.
6.3 Service Fees: Zungo charges a service fee for facilitating the transaction. This fee is clearly displayed prior to finalizing any Booking. By proceeding with a Booking, you agree to these fees.
6.4 Taxes: Users are solely responsible for determining, collecting, reporting, and remitting any applicable taxes related to the services transacted on the Platform.
7. Cancellations and Refunds
Cancellations are governed by the specific Zungo Cancellation Policy and the specific terms set by the Vendor on their profile at the time of booking.
- Customer Cancellations: Refunds for Customer-initiated cancellations will be processed according to the Vendor's selected cancellation tier (e.g., Flexible, Moderate, Strict) and Zungo's processing fees.
- Vendor Cancellations: If a Vendor cancels a confirmed Booking, the Customer will receive a full 100% refund. The canceling Vendor may face penalties, profile demotion, or financial liabilities as outlined in our Vendor agreements.
- Force Majeure: In the event of natural disasters, government mandates, or extreme unforeseen circumstances preventing the event, Zungo will mediate a fair resolution, which may include full or partial refunds or rescheduling.
8. User Content and Intellectual Property
8.1 Your Content: Users may post reviews, photos, videos, and portfolio items. You retain ownership of your content. However, by uploading content to Zungo, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for marketing and platform operation purposes.
8.2 Zungo Intellectual Property: All branding, logos, code, algorithms, UI/UX designs, and text created by Zungo remain the exclusive property of Zungo. You may not copy, reverse-engineer, or distribute any part of the Platform without our explicit written consent.
9. Prohibited Activities
You are strictly prohibited from engaging in the following behaviors:
- Using the Platform for any fraudulent, abusive, or illegal activity.
- Posting discriminatory, hateful, sexually explicit, or violent content.
- Harassing, threatening, or intimidating other Users or Zungo staff.
- Deploying bots, scrapers, or automated scripts to extract data from the Platform.
- Attempting to hack, disrupt, or compromise the security and integrity of our servers and networks.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Zungo, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of:
- Your access to or use of, or inability to access or use, the Platform.
- Any conduct, performance, or failure to perform by any Vendor or Customer.
- Property damage, personal injury, or emotional distress resulting from an event booked through Zungo.
- Any unauthorized access to our secure servers and/or any personal data stored therein.
11. Indemnification
You agree to defend, indemnify, and hold harmless Zungo and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your User Content, any interactions with other Users, and your provision or receipt of services.
12. Dispute Resolution & Governing Law
These Terms shall be exclusively governed by and construed strictly in accordance with the laws of India, specifically including but not limited to the Indian Contract Act, 1872, and the Information Technology Act, 2000, along with applicable rules and amended provisions pertaining to electronic records, without regard to its conflict of law provisions.
Any disputes arising out of or related to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation by contacting Zungo Support. If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra, India.
13. Modifications to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of significant changes by updating the "Last Updated" date at the top of this document or by sending a direct notification to registered Users. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.
